1. Acceptance and eligibility
These Terms of Service (the “Terms”) are an agreement between you and Tandem ([Entity name TBD]) governing your use of the Tandem mobile application and the website at tandemtt.vercel.app (together, the “Service”). By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
To use Tandem, you must:
- Be at least 18 years old.
- Be located in Trinidad and Tobago. Tandem is currently offered only in Trinidad and Tobago, and our content, listings, and operations are scoped to that jurisdiction. We may expand later.
- Sign in using a Meta (Facebook) account. By signing in, you also agree to Meta’s applicable terms as part of the OAuth handoff.
- Have the legal capacity to enter into a binding contract under the laws of Trinidad and Tobago.
2. What Tandem is (and isn’t)
Tandem is a marketplace facilitator. We are not a party to any transaction between Clients and Providers. Providers are independent business owners and independent contractors of Clients, not employees, partners, representatives, agents, joint venturers, or franchisees of Tandem.
What this means in practice:
- We do not perform services. We do not vouch for the quality, timeliness, safety, or legality of any service offered or performed through Tandem.
- We do not process payments. Tandem does not facilitate, hold, or take a cut of payments between Clients and Providers. Payment terms, methods, and timing are arranged entirely between Client and Provider, off-platform.
- Verification badges and trust signals are not endorsements. Any badge, rating, response-time indicator, or other trust signal displayed on the Service reflects point-in-time information available to us; it is not a certification, an endorsement, or a guarantee of competence, safety, or legal compliance.
3. Account and sign-in
- Meta sign-in only. Tandem accounts can only be created and accessed by signing in through Meta (Facebook). We do not currently support any other sign-in method.
- One account per person. You may hold only one Tandem account. You may not transfer your account to another person.
- No re-registration after a ban. If we have suspended or terminated your account for violating these Terms, you may not create a new account, including by using a different Meta account, without our written permission.
- Suspension and termination. We may suspend or terminate your account, with or without notice, where we reasonably believe you have breached these Terms, where required by law, or where your conduct poses a risk to other users or to the Service.
4. Provider obligations
If you use Tandem as a Provider, you agree to:
- Keep your listings accurate. Services offered, pricing structure, location, service radius, and any stated qualifications must be current and truthful.
- Hold any licences, permits, and registrations required by Trinidad and Tobago law for the service category you are offering.
- Honour the engagements you accept, or notify the Client promptly if you cannot.
- Handle your own tax compliance. You are responsible for declaring your earnings and for paying any tax that applies under Trinidad and Tobago law. Tandem does not collect, withhold, or remit tax on your behalf, and Tandem does not issue tax documents.
- Deliver services safely and in compliance with applicable workplace, consumer-protection, and other laws.
- Not circumvent the platform. If a Client first contacts you through Tandem, you may not redirect that engagement off Tandem for the sole purpose of avoiding platform visibility on it.
5. Client obligations
If you use Tandem as a Client, you agree to:
- Provide accurate information when requesting quotes or describing the work you need.
- Honour quotes you accept, or notify the Provider promptly if you cannot.
- Keep personal contact details out of any post or content that is visible to all users. Do not disclose another user’s full name, home address, phone number, email address, or other personal information in a listing, review, or other publicly visible content. Use the in-app messaging system to share such details with the specific counterparty when needed.
- Not harvest contact information. You may not collect Provider contact details systematically — whether by scraping, by bulk copying, or by any automated means — for use outside Tandem.
6. Acceptable use and prohibited content
The following uses of Tandem are prohibited:
- Posting illegal content, including child sexual abuse material, content that promotes or facilitates violence, fraud, or services that are unlawful under Trinidad and Tobago law.
- Harassment, hate speech, threats, or doxxing of any user.
- Impersonation — claiming to be a Provider you are not, or to be another user.
- Distributing malware, attempting to phish other users, or exploiting vulnerabilities in the Service.
- Off-platform payment circumvention as described in Section 4.
- Re-registration after a ban as described in Section 3.
- Recording in-person interactions between Clients and Providers, including conversations and video, without the prior written consent of every person being recorded. This applies in particular to in-home service visits.
7. User-generated content and licence
You retain ownership of the content you post on Tandem (your profile information, listings, portfolio images, messages, quotes, and reviews — together, “Your Content”).
You grant Tandem a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, display, and adapt Your Content for the purpose of operating the Tandem platform and promoting your participation in it. The licence is limited to what is reasonably necessary for those purposes. We do not claim any licence to your name, likeness, or voice beyond what is necessary to display your profile and Your Content within the Service.
To request the removal of content that you believe violates these Terms or your rights, email support@tandem.tt with the subject line “Takedown”. We will evaluate the request under Section 6 and applicable law.
8. Reviews, ratings, and disputes
- Honest reviews only. Reviews must be based on actual experience with a Client or Provider on Tandem and must be written honestly.
- Removal. We may remove or edit reviews and other content that violate Section 6 or this Section 8, including content that is defamatory, off-topic, or retaliatory.
- Disputes between users. Disputes between Clients and Providers should first be raised through the in-app dispute system. We expect both parties to engage in good-faith informal resolution before escalating. If a dispute cannot be resolved through the in-app system, it may be brought before the courts of Trinidad and Tobago (see Section 12).
9. Verification, badges, and trust signals
- What Meta sign-in verifies. The Meta sign-in process confirms that a Meta account exists and that the person using Tandem could authenticate to it. It is not identity-document verification, and it is not a background check.
- Trust signals are point-in-time. Badges, completed-job counts, response-time indicators, and repeat-client counts reflect data available to us at the moment they are displayed. They are not endorsements, certifications, or guarantees, as stated in Section 2.
- Reserved right to request more. We reserve the right to ask any user to verify their identity or qualifications before continuing to use the Service, including in connection with high-value listings, disputes, or suspected violations of these Terms.
10. Termination and survival
Either party may end this agreement at any time. You can end it by deleting your account (Section 9 of the Privacy Policy, and the instructions at /data-deletion). Tandem can end it by suspending or terminating your account as described in Section 3.
The following provisions survive termination, to the extent applicable to events occurring before termination: Section 7 (the licence in already-published Content); Section 11 (Disclaimers, Liability Limits, and Indemnification); Section 12 (Governing Law); and any indemnification obligation that accrued before the termination date.
11. Disclaimers, liability limits, and indemnification
As-is service
The Service is provided “as is” and “as available”. To the extent permitted by applicable law, Tandem disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.
Tandem makes no warranty about the performance, qualifications, safety, or legal compliance of any Provider, and no warranty about the conduct or solvency of any Client. We are not liable for service-delivery failures between Clients and Providers, for off-platform conduct between them, or for content posted by users.
Domestic and personal use
Clients use Tandem for domestic and personal purposes. To the extent permitted by applicable law, Tandem is not liable to any Client for loss of business, loss of profit, loss of goodwill, loss of business opportunity, or any other indirect or consequential loss connected to a Client’s commercial use of the Service.
Liability cap
To the extent permitted by applicable law, Tandem’s total aggregate liability to any user, however arising — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — is limited to TT$100 per claim and to TT$1,000 in aggregate per user per any rolling 12-month period.
This limitation does not apply to liability for gross negligence, wilful misconduct, fraud, or any liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify Tandem against any third-party claim arising out of (a) your breach of Section 4, Section 5, or Section 6, and (b) any third-party claim arising out of content you posted on Tandem. This indemnity is limited in scope to the matters in (a) and (b) above.
12. Governing law, disputes, changes, notices
Governing law and courts
These Terms are governed by the laws of Trinidad and Tobago. The courts of Trinidad and Tobago have jurisdiction over any dispute arising from or in connection with these Terms or the Service. Before bringing a dispute to court, you agree to attempt informal resolution by emailing support@tandem.tt and engaging with us in good faith for at least 30 days.
Changes to these Terms
We may update these Terms from time to time. For material changes, we will provide notice in the app and by email to the address on your account at least 30 days before the change takes effect. If you keep using the Service after the notice period, the updated Terms apply to you. Non-material changes (clarifications, typographical fixes, contact-information updates) take effect when posted, with the updated date shown at the top of this page.
Notices
By using the Service, you consent to receive legal notices from Tandem electronically — through email to the address on your account and through in-app messages. You may send notices to us at support@tandem.tt, or by post to [Registered office address TBD].
